Our client was a rear seat passenger in a car driven by her boyfriend who lost control of the car causing it to veer to the right, leave the road and come to rest at the bottom of a dyke.
The boyfriend's insurers accepted the accident was his fault but there was an issue as to how much compensation our client should receive for the injuries and financial losses she had suffered. She suffered a neck injury from which she made a full recovery within 18 months, a left shoulder soft tissue injury which caused her discomfort for 6 to 8 months, a minor ankle sprain which settled within a few weeks and extreme anxiety when travelling as a passenger.
The insurers offered £2,750 for the injury element of the claim and refused to increase the offer. Accordingly we issued Court proceedings and following an Assessment of Damages hearing at Norwich County Court our client was awarded £3,750 for the injury element of the claim.
She received a total award of over £5,300 once the claim for expenses and interest had been added which was substantially more than the insurers had offered and which many would have advised her to settle for to avoid the need for proceedings to be issued. By going the extra mile we were able to achieve a much better outcome for our client.
