NO WIN NO FEE (and the other options)
We will ensure that your claim will not cost you a penny, win or lose.
There are generally two main ways of funding your claim:
The No Win No Fee Agreement (also known as a conditional fee agreement)
The agreement itself is a long and, on the face of it, complex document. The way in which it works is however quite straightforward.
At comercrawley, we offer a true 'no win - no fee' service, which means that we ensure that your claim will not cost you a penny, win or lose. We only ask that you cooperate with us and act honestly.
We act for clients on a no win - no fee basis in the hope and expectation that the claim will be successful, in which case we will recover the costs of your claim, as well as your compensation (the general rule is that the loser pays the winner's costs).
If you lose your case, the no win no fee agreement means that you do not have to pay our legal costs (we don't get paid).
We also promise you that if your claim is successful you will receive all of the compensation paid.
There are other legal costs involved in pursuing a claim for compensation. As well as your own solicitor's fees, there will be other expenses incurred in pursuing the claim. These are called 'disbursements' and include fees for medical records, medical reports, police reports and court fees. We take care of these for our clients - on the basis that if the claim is successful we will recover the fees from the other party.
We will also ensure that you will not be responsible for paying your opponent's costs if your claim is unsuccessful after court proceedings have started.
Whilst it is possible to insure against this risk, unlike many firms we do not believe that it is necessary to routinely insure cases (as the vast majority settle without the need for legal proceedings). If we feel that an insurance policy is necessary we will pay the insurance premium on your behalf, where appropriate.
Effectively we take the risk of losing a case ourselves.
Legal Expenses Insurance
This means Before The Event legal expenses insurance.
If you have legal expenses insurance cover linked to your motor, household or other type of insurance policy, you may not need to enter into a no win no fee agreement. Some legal expense insurance policies allow you to choose your own solicitor. We will advise fully concerning any legal expenses insurance policy that you may have.
Trade Union Membership
You may have legal expenses assistance through any Trade Union that you belong to.
However your claim is funded, we guarantee not to take a penny of your compensation. All compensation received in settlement of your claim will be paid direct to you.
